1. Introduction

Bigmind B.V. ("Bigmind", "we", "us", or "our"), registered in the Netherlands, provides an AI-powered meeting assistant platform accessible through our website and browser extension (the "Services"). By using our Services, you agree to these Terms of Service ("Terms").

2. Service Provision and Termination

2.1. Bigmind reserves the right, at its sole discretion, to terminate or suspend your access to the Services with 14 days notice, for any reason whatsoever, without liability.

2.2. We may also terminate or suspend your access immediately and without notice if you breach these Terms.

3. User Responsibilities and Consent

3.1. You are solely responsible for obtaining all necessary consents and permissions from meeting participants before using our Services. This includes, but is not limited to:

• Consent for recording meetings
• Consent for AI processing of meeting content
• Consent for storing and sharing meeting transcripts
• Compliance with workplace privacy policies

3.2. Bigmind assumes no responsibility for your failure to obtain necessary consents or comply with applicable laws and regulations.

4. Payment Terms

4.1. Subscription fees are billed in advance on a monthly or annual basis.

4.2. All payments are non-refundable unless required by Dutch law.

5. Data Processing

5.1. Our processing of personal data is governed by our Privacy Policy and applicable Dutch and EU data protection laws.

5.2. You remain the data controller for any personal data processed through our Services.

6. Limitation of Liability

To the maximum extent permitted by Dutch law, Bigmind shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

7. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through our Services. Your continued use of our Services after such notification constitutes acceptance of the modified Terms.

8. Governing Law

These Terms are governed by Dutch law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Amsterdam, Netherlands.
